The employer has the right to transfer employees to remote work, even if this is not provided for by the employment contract, the press service of the Ministry of Labor said.

The ministry clarified that in order to prevent the spread of coronavirus, “employers can organize the use of flexible working regimes for employees,” even if this was not initially provided for by the employment contract, RIA Novosti reports.

The Ministry of Labor explained that the employer must issue a corresponding order. The document must reflect the working conditions: start and end times, working hours and other conditions, if necessary.

In addition, the employee and the employer can remotely exchange electronic samples of documents, but then issue them in the prescribed manner.

“The wages for remote employment while maintaining the job duties that are assigned to the employee remain unchanged,” the ministry added.

On July 21, the State Duma adopted in the first reading a bill on the specifics of regulating remote work. The document strengthens the protection of those who work remotely. They are guaranteed a time when employees have the right not to contact the employer. Also, the draft law limits the list of grounds for dismissing teleworkers.
