The draft Roskomnadzor (RKN) order on the collection of consent for the processing of publicly available personal data does not oblige social networks and instant messengers to receive passport data of new users. This was announced by a member of the State Duma Committee on Information Policy Anton Gorelkin.
According to him, social networks and messengers will have a choice. They will be able to either launch their own services to obtain consent from users for the dissemination of their personal data, “or use the EIS (unified information system) of Roskomnadzor,” reports TASS.
“We are not talking about forcing to use only the Roskomnadzor system, the novels will affect only new users of social networks,” the deputy explained.
He noted that if the requirement to obtain consent from users for the dissemination of personal data is not met, “the actions of sites (both foreign and Russian) can be qualified as data processing in cases not provided for by law.”
“For such violations, administrative responsibility is established by Part 1 of Article 13.11 of the Administrative Offenses Code of the Russian Federation,” Gorelkin clarified.
This norm entails a warning or the imposition of an administrative fine on citizens in the amount of 1 thousand to 3 thousand rubles, on officials – from 5 thousand to 10 thousand rubles, on legal entities – from 30 thousand to 50 thousand rubles.
Earlier on Wednesday, Roskomnadzor took the initiative to request passport information, phone number, email and residential address when registering new users of social networks and instant messengers. This is stated in the draft order of the department.
On March 23, the deputy head of Roskomnadzor, Vladimir Logunov, during a meeting of the State Duma’s inter-faction group on cybersecurity, proposed to oblige operators of personal data to compensate victims for the leakage of this information. Logunov added that Roskomnadzor plans to work on this idea at the site of the State Duma.
