Russia considered it impossible to release Navalny at the request of the EU

Russia will not release opposition leader Alexei Navalny, who was convicted on its territory in the Yves Rocher case, as part of interim measures at the request of the European Union. As the press service of the Russian Ministry of Justice emphasized, this would be a gross interference in the work of the judicial system of a sovereign state.

It is noted that the adoption of a decision on the basis of Rule 39 of the ECHR Regulation in this case will become “unreasonable and gross interference in the work of the judicial system of a sovereign state.” Thus, it will turn out to be “a definite crossing over the“ red line. ”This decision cannot be enforced from the point of view of international law.

Prior to that, it was reported that the Council of Europe may, through the ECHR, demand that Navalny be released from the Russian authorities. At the same time, they can use for this a decision on the application of interim measures in accordance with Rule 39 of the ECHR Regulation.

On February 13, Navalny’s defense appealed to the Committee of Ministers of the Council of Europe. There they announced that Russia had failed to comply with the ECHR decision in the Yves Rocher case. Now the defense side will ask to use Article 46 of the Convention for the Protection of Human Rights and Fundamental Freedoms in relation to the Russian Federation.
