Germany: Court allowed more than 5 families to meet

Despite the restrictions in force in Germany, according to which family members can meet with one person from another household, families in Saarland are temporarily allowed to meet again with two or more households, exceeding the limit of 5 people.

This possibility is based on the fact that the regulation on the introduction of restrictions to combat the coronavirus has been partially suspended, as announced by the Supreme Administrative Court of the Saarland (OVG). In this particular case, the court ruled in favor of a woman who, like her husband, was prohibited from seeing her grandchildren and their parents in accordance with the current ruling.

The basis for the court decision is two conflicting provisions of the current decision. On the one hand, they state that members of one household can meet with one member of another family. On the other hand, the rules for limiting social contacts do not apply to family members. According to the judges, this is a contradiction. It is not clear from the ordinances which rule is applicable.
