Anna Selezneva, a resident of St. Petersburg, who was injured in a terrorist attack in the metro, has sued 1.5 million rubles from the Petersburg Metro State Unitary Enterprise as compensation for moral damage. The metro, which had previously paid the woman 2 million rubles for causing harm to health, did not agree with the decision of the Primorsky District Court and has already filed an appeal.
On that terrible day for St. Petersburg, April 3, 2017, 18-year-old student Anna Selezneva went to a beautician. I woke up in a hospital ward. The first hours after the tragedy, Anna was listed as “victim 512”. Doctors diagnosed an open craniocerebral injury, shrapnel wounds, and fractures. To save the girl’s life, she was put into a drug-induced coma. She was in it for two weeks. And then I learned to walk again.
When filing a lawsuit, Anna Selezneva reported that as a result of the terrorist attack her health was harmed, and she spent 301 days in medical institutions. On July 1, 2019, she was re-established disability indefinitely. The size of the disability pension amounted to 6,865 rubles 5 kopecks. Anna Selezneva asked to collect compensation for moral damage from the St. Petersburg metro. It was valued by a woman at 10 million rubles.
“At the hearing the representative of the defendant by proxy Ankudinova A.The. she did not recognize the claim, she asked to dismiss the claim in full. The defendant is not the inflictor of harm to the plaintiff, the plaintiff had the opportunity to file claims for compensation for non-pecuniary damage in the framework of the criminal case “, – announced the position of the State Unitary Enterprise “Metropolitan” United Press Service of the Courts of St. Petersburg (OPS).
During the meeting, the court found that the metro had already paid Anna Selezneva 2 million rubles for causing harm to her health.
“At the time of the plaintiff’s injury, the responsibility for ensuring safety in the metro was assigned to the defendant as a subject of transport infrastructure. Thus, given the lack of evidence on the part of the defendant confirming the proper provision of safe transportation of passengers, as well as the fact that a terrorist act is a crime and cannot be attributed to force majeure circumstances, the court concluded that the claims were satisfied “, – said the OPS.
The court recovered 1.5 million rubles in favor of the Petersburg woman. State Unitary Enterprise “Petersburg Metro” did not agree with the court decision and has already filed an appeal.
