─ Hello, MK-Compatriot, dear lawyers! Thanks for your invaluable help.
We have a difficult relationship with a neighbor who lives in a neighboring house. She is terribly jealous and constantly finds fault with everything. Writes anonymous letters that we sort the garbage incorrectly, that we mock animals when we leave and leave them in the yard of the house (with food and drink). The other day my son (6 years old) was playing with a dog with a ball, and he flew to her site. The son ran to her without asking permission (there is no fence between the sites), and she pounced on him. And soon I heard that my son was crying. It turns out that a neighbor said that some animals eat poisoned food and die. And she wishes it to our pug and to all of us. The child has been in shock for almost a week. Doesn’t want to go anywhere. He also does not go to the garden to guard the pug. I do not know what to do. Tell me, is it possible to somehow influence the neighbor? I tried to talk to her, but she just grinned, said that something else could happen. And then she said that she would always deny everything that I say about her. And my opinion – a foreign woman, against her – a German, has no weight at all!
Where should you go in such cases? Can this be qualified as psychological abuse? How to prove it?
Natalia T., Mainz.
─ Dear Natalia!
Relationships between neighbors are an eternal theme. It is not so much legal measures that are important here as life experience and life wisdom. If, nevertheless, we talk about legal mechanisms, then you can file a factual application to the prosecutor’s office with a request to check the circumstances for corpus delicti. Most likely, the case will not end with punishment, but the desire to do this will disappear from the neighbor for a long time. Alternatively, you can, through a lawyer, file a claim in a civil court for the recovery of non-pecuniary damage.
