The court considered the case of a pensioner who knocked down a bear at the 4 km driveway to the village of Slobodino, Totemsky District. As a result of an accident, the animal died.
The regional department for the protection, control and regulation of the use of objects of the animal world filed a claim with the court. According to experts, the pensioner drove a UAZ car – a source of increased danger, which means he had to take special care while driving, especially in the forest belt where the accident happened. The department calculated that the damage caused amounted to 60 thousand rubles.
The defendant, in his defense, explained that there were no signs and necessary barriers on that section of the road. In addition, he drove in the dark with poor visibility, so he simply did not have the opportunity to prevent a collision.
The court partially satisfied the department’s demands and ordered the pensioner to pay the damage caused to the hunting resources in the amount of 45 thousand rubles.
